Gold My Way.com, LLC (“We” or “Gold My Way”) provides this policy to describe how data on or relating to www.goldmyway.com (“Our Website”) and Our services is collected, obtained, used, disclosed, or processed, how it’s used and shared, and your choices regarding this data.

  • Scope

    This notice applies to users of Gold My Way’s Website or other services anywhere in the world where our services are offered, including users of Our Website. It governs any data that is provided to or collected by or through our services. To the extent our services are not offered in a country, users in such countries shall be deemed to agree to the provisions herein to the extent the terms are allowed under the applicable law.

  • Information that We May Collect

    We may collect the following data or information: (i) Data provided by users to Gold My Way, such as during account creation or submitting an Appraisal Packet; (ii) Data created or provided to use or during use of our services, such as contact information, location, website usage, and device data; and (iii) Data from other sources, such as our partners, public databases, and third-parties that use or help us provide our services. These data may include the following:

    (i). Data provided by users, includes for example, data when users create or update their Gold My Way accounts. This data may include their name, email, phone number, login name and password, address, picture, payment or banking information (including related payment verification information), government identification documents, including driver’s license numbers and images, birthdate, signature, and photo. This data also includes insurance information of users and information regarding their property. We may also collect data about a user’s hardware and software and his or her use of the website, including for example, browser information, operating system, IP addresses, data relating to referral sites or recently visited sites, browser behavior during use of our services, data relating to the dates and time Our Website or use or services are accessed, visited, or used, and other click-stream data. We may collect data relating to user settings. When users request an appraisal or otherwise use any of Our services, We may collect and use data to verify a user’s identity, check a user’s background, detect fraud, ensure security, and comply with the law, including information such as credit history, litigation history, or criminal record (where permitted by law). This information may be collected by an authorized vendor on Our behalf. We may also collect demographic data about users, including through user surveys. We may also collect information that users submit when they contact Gold My Way customer support, provide feedback, or otherwise contact Gold My Way.

    (ii). Data created and collected during use of our services may include the information identified in part (i), as well as location data from a user’s device (if enabled by the user). Gold My Way may collect this data when the Gold My Way Website or app is running in the foreground (open and on-screen) or background (open but not on-screen) of their device. If you do not enable Gold My Way to collect location data from your device, some functionality available in Our Website or other services may be affected. The location data collected from users will be linked to their account, even if they have not enabled location data to be collected from their device, including for purposes of user verification, customer support, fraud detection, insurance, and litigation. Gold My Way also may collect transaction information related to the use of our services, including the appraisals requested or provided, order or appraisal details, information about items to be appraised, insurance information, date and time relating to the provided services, appraisal data, charges or disbursements relating to our services, services sought and/or offered, and payment methods. If someone uses a promotion code that you provide, we may associate your name with that code and information related thereto. Gold My Way may collect data about how users interact with our services, including for example, data such as access dates and times, features or pages viewed, crashes and other system activity, type of browser, and third-party sites or services used before interacting with our services. In some instances, we may collect this data through cookies, pixels, tags, and similar tracking technologies that create and maintain unique identifiers. Gold My Way may also collect device data for devices used to access or use our Website or our services, including for example, data relating to hardware, IP addresses, operating systems, software, preferred languages, unique device identifiers, advertising identifiers, serial numbers, device motion data, and mobile network data. Gold My Way communications data, including for example, data relating to users who communicate with Gold My Way through Gold My Way’s Website or apps, including the date and time of the communications and the content of the communications. Gold My Way may also use this data for customer support services (including to resolve disputes), for safety and security purposes, to improve our products and services, and for analytics.

Data from other sources that Gold My Way collects may include user feedback (e.g., ratings, feedback, or compliments); data from users participating in a referral program; data from users who request services for or on behalf of other users, e.g., legal representatives, or others with legal authority to act on a person’s behalf; data from users or others providing information in connection with claims or disputes; data or information from Gold My Way business partners through which users create or access their Gold My Way account, such as payment providers, social media services, or apps or websites that use Gold My Way’s APIs or whose APIs Gold My Way uses; data from Gold My Way business partners; data from Gold My Way’s Vendors who help us verify users’ identity, background information, and insurance information for regulatory, safety, and security purposes; from insurance providers; and data obtained from publicly available sources or through marketing service providers.
    Gold My Way may combine the data collected from these sources with other data in its possession. 

  • Our Use of Data

    Gold My Way collects and uses data to allow a reliable, secure, and convenient way for users to sell unwanted gold and other valuable metals, to minimize the risk of fraud, and to provide other products and services that our users may desire. We also use the data we collect: to enhance the safety and security of our users and services; to make automated decisions relating to use of our services; for customer support; to maintain and improve our services, including personalization; for research and development; to enable communications with users; to send marketing and non-marketing communications to users; in connection with legal proceedings; or as required by law. We do not sell or share user personal data with third parties for their direct marketing without a user’s consent.

  • Our Use of Cookies

    Our Site may use cookies (small text files that are stored on the user’s computer when they access Our Website) or other tracking mechanisms to collect data or information, and such cookies or other information may be combined with a user’s personally identifiable information (name, email, address, IP address, etc.) to optimize your experience on Our Website, for example, by enabling services is tailored to your preferences and allows you to sign-in automatically without having to re-enter your password each time.     Our Web site and Other Web Pages that are accessible through our online marketing campaigns may contain links to other third-party web sites (such as those of our advertisers), which may have privacy policies that differ from our own. We are not responsible for the activities and practices that take place on these web sites.     We may also engage third-parties to track and analyze non-personally identifiable usage and volume statistical information from visitors to Our Website to help us administer Our Website and improve its quality. Such third-parties may use cookies to help track visitor behavior. These cookies will not be used to associate individual visitors with personally identifiable information. We do not have access to third-party cookies. This policy only governs the Our use of cookies.

    We also use third-party audience data such as age, gender and interests to better understand the behavior of Our customers and collaborate with companies that collect information about your online activities to provide advertising targeted to suit your interests and preferences.   • Updating Your Personal Information

    If your personal information changes or if you no longer desire to use Our services, you may correct or update your information by emailing us at support@goldmyway.com or by contacting us by telephone or postal mail at the address listed below.

  • Data Retention and Deletion

    We retains user information, transaction, and other personal data for as long as a user maintains an account. We may retain certain user data after receiving an account deletion request if necessary (and only to the extent permitted by law), such as to comply with legal requirements.

    Users may delete their account at any time by emailing
    support@goldmyway.com. Following such requests, Gold My Way deletes the data that it is not required to retain for purposes of regulatory, tax, insurance, litigation, or other legal requirements. In certain circumstances, We may be unable to delete a user’s account, such as if there’s an outstanding credit on the account or an unresolved claim or dispute. Upon resolution of the issue preventing deletion, Gold My Way will delete the account as described above.

    We may also retain certain information if necessary for purposes of safety, security, and fraud prevention. For example, if we deactivate a user’s account because of fraudulent behavior, Gold My Way may retain certain information about that account to prevent that user from opening a new Gold My Way account in the future.

  • Children

    We do not knowingly collect information from users under 18. To use our services, including to submit an Appraisal Packet, receive an offer from us, or to enter into a transaction with us, we will require a user to verify his or her age.

  • Security

    We use industry-accepted standards to protect your information, including SSL encryption when transmitting sensitive information. We have implemented certain physical, encrypted, electronic, and managerial procedures to safeguard and secure the information we collect. Visitors should consider any electronic communication that they transmit to us (such as data, questions or answers, comments, suggestions, or other communications) to be non-confidential. While we take every precaution to protect your information, we cannot guarantee 100% safety and highly recommend being careful in the information that you provide in email or submit to us via Our Website. We will not be liable nor responsible if your information is intercepted and used by an unintended recipient, or is otherwise accessed and used without our written permission.

  • Your Authorization for Telephone Calls

    If you request information through our Site’s inquiry form and submit your telephone number, you authorize Us or Our Affiliates to contact you at that number to respond to your inquiry to give you information relating to Our services. Unless you withdraw this authorization, it shall be valid for the three (3) month period following date that you submitted your inquiry.

  • Choice and Transparency

    Gold My Way enables users to access and control the data that Gold My Way collects, including through user settings in our Website, device permissions, ratings pages, and marketing opt-outs. Gold My Way also enables users to request access to or copies of their data, changes or updates to their accounts, deletion of their accounts, or that Gold My Way restrict its processing of user personal data. To the extent such request is not provided through a service, users may make a request by emailing support@goldmyway.com.

    Users may also opt out of receiving promotional emails from Gold My Way
    here. Users may also opt out of receiving emails and other messages from Gold My Way by following the unsubscribe instructions in those messages. We may still send email to users who have opted out non-promotional communications, such as receipts for sales or information about their account.

    We take all reasonable measures to ensure that your unsubscribe requests are fulfilled in a timely manner. Despite these efforts, inadvertent technical or other processing errors are inevitable. If you receive marketing emails after unsubscribing, please notify us of those communications by writing to
    optout@goldmyway.com and we will take immediate steps to rectify the situation.

    For third-party technologies, you may opt out of the automated collection of information by third-party networks for the purpose of delivering advertisements tailored to your interests, by visiting the consumer opt-out page for the Self-Regulatory Principles for Online Behavioral Advertising at
    http://www.aboutads.info/choices/ and edit or opt-out of your Google Display Network ads’ preferences at http://www.google.com/ads/preferences/. Because these opt-out and preference control pages are specific are specific to the individual browsers, you will have to opt-out of them for each browser that you use. We do not operate or control these control pages so we are unable to perform opt-out of them on your behalf.

  • Updates to this Notice

    We may occasionally update this notice. If we make significant changes, we will notify users in advance of the changes through Our Website or through other means, such as email. We encourage users to periodically review this notice for the latest information on our privacy practices. After such notice, use of our services by users will be understood as consent to the updates to the extent permitted by law.

  • Transfer of Ownership

Additional Terms for California Residents

The California Consumer Privacy Act (CCPA) is a privacy law that became effective on January 1, 2020. This law grants California residents new rights with respect to their personal information. In addition to Our standard policy terms, the following terms apply to California residents who visit or use www.goldmyway.com or any other services that Gold My Way LLC (“We” or “Gold My Way”) provide.

Gold My Way’s Policy on Selling Data

We do not sell your data, we are not data brokers, and we do not put your data on the open market. Under the CCPA, however, some sharing of personal information necessary to provide you with personalized ads may be considered a “sale” even without a monetary exchange. To opt-out of these types of exchanges, see the opt-out option below. When you opt-out, Gold My Way will stop sharing your information with some of its advertising partners. As a result, you may no longer receive personalized offers from Gold My Way on some sites or services.
